Conditions of Sale
The owner of the online store babortallinn.ee (hereinafter referred to as the “Web Store”) is Beautyspa Baltic OÜ (registration code 14348310), located at Pärnu mnt. 18, Tallinn, 10141, Harjumaa, terms of sale.
VALIDITY OF SALES CONTRACT, PRODUCT, AND PRICE INFORMATION
These terms of sale apply to the purchase of goods from the Web Store.
The prices of products sold in the Web Store are indicated next to the products. All prices listed in the online store include a 20% value-added tax (VAT). The price does not include the delivery fee for the goods.
The order becomes effective upon the receipt of the payable amount to the Web Store’s bank account. Payment for the goods is made in Euros (EUR), and to place an order, the customer needs to create a user account on the e-store, log in, and make the payment via bank link.
The delivery fee for the goods depends on the buyer’s location and the chosen delivery method. The delivery fee is displayed to the buyer during the order process.
Information about the products is provided directly next to the product in the Web Store.
All products purchased from the online store can be returned within 14 days from the date of receipt, provided that the package is unopened.
ORDERING PROCESS
To order products, the desired items must be added to the shopping cart. For the first purchase, the customer must create a user account and fill in the required data. When creating a user account, the customer needs to check the box indicating “I have read the terms of sale and privacy policy and agree to them” and confirm the order. Then the total amount to be paid will be displayed, and the payment can be made via a bank link.
If the ordered goods cannot be delivered due to stock depletion or any other reason, the buyer will be notified as soon as possible, and the paid amount (including delivery costs) will be refunded without delay, but no later than within 14 days from the date of notification.
Beautyspa Baltic OÜ is the data controller of personal data, and it transfers the necessary payment data to the authorized processor Maksekeskus AS for payment processing.
DELIVERY
Goods are sent within Estonia only via Venipak courier or Itella SmartPost.
The buyer bears the shipping costs, and the corresponding price information is displayed next to the shipping method.
In general, domestic shipments are delivered to the buyer’s designated destination within 5-7 business days from the effectiveness of the sales contract.
In exceptional cases, the delivery period may be extended to up to 45 calendar days.
RIGHT OF WITHDRAWAL
After receiving the order, the buyer has the right to withdraw from the sales contract within 14 days.
The right of withdrawal does not apply if the buyer is a legal person.
To exercise the 14-day right of withdrawal, the buyer must not use the ordered goods in any other way than necessary to ascertain the nature, characteristics, and functioning of the goods in the same way it would be allowed in a physical store for testing.
If the goods have been used for purposes other than those necessary to ascertain their nature, characteristics, and functioning, or if there are signs of use or wear, the Web Store has the right to reduce the amount to be refunded in accordance with the decrease in the value of the goods.
To return the goods, the buyer must submit a declaration of withdrawal from the purchase, which can be found here: withdrawal declaration, and send it to the email address info@babortallinn.ee no later than 14 days from the date of receipt of the goods.
The buyer must bear the costs related to the return of the goods unless the reason for the return is that the returned item does not correspond to the one ordered (e.g., wrong or defective item).
The buyer must return the goods within 14 days from the submission of the withdrawal declaration or present evidence that they have handed over the goods to the carrier within the aforementioned period.
Upon receiving the returned goods, the Web Store will refund the buyer without delay but no later than 14 days after receiving the withdrawal declaration all payments received from the buyer under the sales contract.
The Web Store may withhold the refund until the goods have been returned or until the buyer has provided evidence that they have returned the goods, depending on which event occurs first.
If the buyer explicitly chooses a delivery method other than the cheapest standard delivery method offered by the Web Store, the Web Store is not required to reimburse the additional costs incurred by the buyer.
The Web Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the online store has been significantly marked incorrectly due to an error.
RIGHT TO SUBMIT COMPLAINTS
The Web Store is responsible for any non-conformity or defects in the goods sold to the buyer that already exist at the time of delivery and that appear within two years from the date of delivery. During the first six months from the date of delivery, it is presumed that the defect already existed at the time of delivery. It is the Web Store’s obligation to refute such presumption.
In the event of defects in the goods for which the Web Store is responsible, the Web Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Web Store will refund all fees related to the sales contract to the buyer.
The Web Store will respond to the consumer’s complaints in writing or in a format that allows written reproduction within 15 days.
DIRECT MARKETING AND PROCESSING OF PERSONAL DATA
The Web Store uses the customer’s entered personal data (including name, telephone number, address, email address, and bank details) solely for processing the order and delivering the purchased goods to the customer. The Web Store may disclose personal data to transportation service providers for the purpose of delivering the goods.
The Web Store will send newsletters and offers to the buyer’s email address only if the buyer has expressed their wish to receive such communications by providing their email address on the website and expressing consent to receive direct marketing messages.
The buyer has the right to opt-out of receiving offers and newsletters sent to their email at any time by notifying us via email or following the instructions provided in the marketing emails.
DISPUTE RESOLUTION
If the buyer has any complaints about the Web Store, they must be sent to the email address info@babortallinn.ee or call the phone number: +372 5680 5550.
If the buyer and the Web Store fail to resolve the dispute by agreement, the buyer can turn to the Consumer Dispute Resolution Commission. The conditions for the procedure and the application form can be found here. The Consumer Dispute Resolution Commission is competent to resolve disputes arising from contracts between the buyer and the Web Store. The examination of the buyer’s complaint in the commission is free of charge.
